DENVER—A federal judge wants more information before deciding whether to throw out a challenge to Colorado’s Taxpayer’s Bill of Rights.

The Denver Post reports that U.S. District Judge William Martinez has asked both sides to submit additional arguments (). The judge wants both sides to elaborate on whether the former lawmakers have legal standing to sue.

The lawsuit is challenging the 1992 amendment to drastically limit legislative bodies from being able to tax and spend. The plaintiffs say that the amendment impedes the republican form of government, but state lawyers say the TABOR challenge could endanger all citizen initiatives.

Martinez asked for additional briefs by March 16.
