El Diablo restaurant at First Avenue and Broadway has been ordered to become wheelchair-accessible by the U.S. District Court in Denver.
Judge Richard P. Matsch has requested that a remediation plan be submitted to the court no later than April 23 .
The decision was welcome news to Tim Fox , a Denver lawyer who uses a wheelchair and was lead plaintiff in the case. “I’m very happy with the court’s ruling, and I’m looking forward to patronizing El Diablo,” he said.
Fox has a law office across the street from El Diablo. The restaurant’s dining room was built with two large, raised seating areas that people in wheelchairs can’t use. After El Diablo did not act on several requests from Fox to fix the obstacle, the lawsuit was filed in December 2010 .
Match ruled in favor of Fox, saying alterations made at El Diablo violated the Americans with Disabilities Act.
The Colorado Cross-Disability Coalition represented Fox and other people who use wheelchairs in the case.
