RAPID CITY, S.D.—A judge has ruled that a Denver-based bank that loaned $1 million to a now-defunct women’s shelter on a South Dakota reservation can sue in state court to try to recover its investment.
The Rapid City Journal reports ( ) Native American Bank sued Cangleska in 2010 after the shelter defaulted on the loan. Cangleska sought to have the case dismissed, saying the state court did not have jurisdiction over the nonprofit corporation operating on the Pine Ridge Indian Reservation.
A judge initially sided with Cangleska but the state Supreme Court sent the case back to the circuit court last October. A different judge, Janine Kern, has ruled that Cangleska is a separate entity from the Oglala Sioux Tribe. She says there is no evidence it ever held a tribal charter.
