COLORADO SPRINGS — A fatal crash was caused by a driver’s “inexcusable lack of attention,” a 4th Judicial District prosecutor said Tuesday during opening statements in the trial of Rodney Fannin, a former El Paso County deputy accused of vehicular homicide.

Fannin, 42, allegedly ran a red light last Aug. 3 and broadsided the car that Air Force Capt. Vivian Elmo, 41, was driving as she turned left into the intersection of Colorado 94 and Curtis Road, east of Colorado Springs.

“There will be no dispute as to the cause of Vivian Elmo’s death,” said Timothy Bussey, Fannin’s lawyer, acknowledging that his client was driving the sport utility vehicle that hit Elmo’s car.

Bussey said defense witnesses would confirm that “the light was green” when Fannin drove into the intersection. He repeated that multiple times Tuesday.
