DENVER—A civil service commission has upheld the firing of a Denver police officer who used unauthorized military ammunition in a shooting that left a bystander wounded.

Officer Robert Fitzgibbons was fired last year after an investigation found that the officer had military tracer bullets in his .223-caliber Smith & Wesson rifle when he fired at an armed suspect. The investigation found police were justified in their use of force.

Fitzgibbons was fired for violating department rules and executive orders regarding firearms and other conduct.

According to KMGH-TV ( ), the panel found that Fitzgibbons engaged in conduct prejudicial to the good order and police discipline of the department.
