COLORADO SPRINGS — Colorado Springs Utilities has violated federal law for the past 24 years by making “major modifications” to the Martin Drake and Ray Nixon coal-fired power plants without the necessary permits, the Sierra Club alleges in a filing.

The environmental organization on Monday filed a notice of intent to sue Utilities, claiming that in addition to the unpermitted changes, the city-owned utility did so “without complying with limits on the amount of pollution these power plants emit.”

Utilities spokesman Dave Grossman said the Sierra Club has filed similar legal notices with many coal-fired power plants nationwide in the past few years. He added that Utilities is in compliance.
