The “Kettle Falls Five” case is seen as a sign of federal willingness to go after marijuana growers in a state where medical marijuana has been allowed for more than a decade and voters approved recreational marijuana more than two years ago.
of growing more medical marijuana than it could use. Three defendants remaining in the case could face more than 10 years in prison.
U.S. Assistant Attorney Earl Hicks told jurors Monday the state’s stance on marijuana doesn’t matter. He says the question for the jury is, “Is it legal under federal law?”
A defense lawyer calls it “overzealous, overreaching” prosecution.
