Greeley man convicted in 2010 child sex assault case wins appeal, new trial set

GREELEY — A Greeley man convicted during a child sexual assault case in 2011 — and who was considered a person of interest in a high profile murder investigation — will soon get the chance to defend himself again in Weld District Court.

Robert Laurencio Montoya, now 23, appeared Nov. 16 in Weld District Court for a status conference before Weld District Court Judge Marcelo Kopcow. On Dec. 31, 2014, Montoya won an appeal in his child sexual assault case. During last month’s hearing, Kopcow ordered the case be retried. A new jury trial begins Feb. 1.

Montoya was a person of interest in the March 2010 disappearance and subsequent murder investigation of 12-year-old Kayleah Wilson. Montoya, at the age of 17, engaged in a sexual relationship with Wilson. When the investigation — which is ongoing — failed to produce a murder suspect, Montoya found himself charged with one count each of child sexual assault and child sexual assault with a pattern of abuse, both felonies.
