A man who allegedly took his 21-month-old son in violation of a custody order appeared Wednesday in a Summit County district court.

Joseph David Carter, 25, faces possible second degree kidnapping charges, according to a Summit County District Attorney’s Office media release.

Carter had been ordered by a court not to leave Breckenridge with the child. He was supposed to have returned the toddler to his mother by 9 p.m. on Nov. 25, according to the release.

When Carter failed to return by the 9 p.m. deadline, the boy’s mother called Carter on his cell phone.

“He told her he was taking his son home to South Carolina,” according to the release.

Carter was found in Indianapolis and taken into custody. He waived extradition and was arrested Tuesday by the Summit County Sheriff’s Office.

He appeared in court Wednesday for an advisement hearing.

Prosecutors have until Tuesday Dec. 22 to decide whether to file formal charges against Carter, the release said.
