
Local officials determined to crack down on protesters handing out pamphlets in front of the Denver courthouse on “jury nullification” keep running into justified resistance in the courts. Perhaps their latest setback will convince them to back off and let free speech prevail.
District Court Judge Kenneth Plotz last week dismissed all charges against two protesters charged with jury tampering. The charges reflected the district attorney’s belief that they were targeting potential jurors.
But even if they were, so what? The literature said nothing about a specific case or defendant. It offered general statements about juror rights, which are fair game for speech outside a courthouse.
