
Criminal charges will not be filed against a Northglenn Police Department officer involved in a December shootout at a gas station.
Officer Tim Kuenning was shot by Adrian Moya, 24, during a traffic stop on Dec. 19. Moya was a passenger in the car, and police discovered an arrest warrant for him.
Kuenning returned fire and wounded Moya, who was flown to a Denver hospital in a helicopter.
Kuenning had no choice but to shoot, 17th Judicial District Attorney Dave Young wrote Tuesday in a decision letter to Northglenn Police Chief Jim May.
“Mr. Moya was armed with a handgun and fired upon Officer Kuenning,” Young wrote. “Officer Kuenning stated that he fired his weapon because the suspect was shooting at him.”
A bullet struck Kuenning in the abdomen and chest, but prevented him from being seriously injured.
Moya was shot in the right and left upper shoulders, the chin and in both legs, the letter said. Moya was charged with .
