Woman gets 90 days in jail for charity scam that netted $1 million

Genevieve Cruz pleaded guilty to one felony charge of charitable fraud-scheme and one misdemeanor count of theft in a scam involving the sale of donated mattresses.

A woman who helped run a bogus charity that stole more than $1 million was sentenced on Wednesday to serve 90 days in jail.

Genevieve Cruz, 58, was also sentenced to 4 years of probation during a hearing in Adams District Court, according to a news release from the 17th Judicial District Attorney’s office.

Cruz had pleaded guilty to one felony charge of charitable fraud-scheme and one misdemeanor count of theft.

Adam Shryock — who also founded the fake charity Boobies Rock! — ran the scam with Cruz, pleaded guilty to the same charges and received the same sentence on May 16.

“This is yet another successful prosecution by our Economic Crime Unit,” District Attorney Dave Young said in a statement. “I’m very proud of the accomplishments of our unit in investigating and prosecuting these complex crimes since it was established in 2013.”

Cruz and Shryock were charged in April 2015.

Investigators discovered that the two obtained Serta mattresses under a warranty program, claiming to be donating the mattresses to the Ecumenical Refugee and Immigration Services Inc. in Denver and distributing them to refugees.

Cruz worked as a donation coordinator for the charity.

Shryock and Cruz sold most of the mattresses for profit at reduced prices out of a storage unit in Adams County.

Cruz blamed her involvement on Shryock, but prosecutors argued that she was in charge of the scam.

Senior Deputy District Attorney Robyn Cafasso said in a statement that Cruz lied to Serta to obtained the mattresses and continued to lie when the company became suspicious.

The judge also ordered Cruz to perform 96 hours of community service and pay $50,000 in restitution.

Cruz will begin serving her jail sentence on June 27.
