A Denver man has filed a lawsuit against in response to a 2013 car accident, .

Margarito Gonzalez claims that My Morning Jacket frontman Jim James was following too closely when he collided his Mazda 2 into Gonzalez on I-70 near Monaco Street on July 29, 2013, according to court documents obtained by Reverb.

Gonzalez filed the initial claim on May 17 in Boulder County District Court. On Tuesday, a lawyer for Jim James, whose real name is James Olliges, moved to hear the case in federal court.

Gonzales stated that the accident caused personal injury and disfigurement that hasn’t allowed him to enjoy his life as he did before the wreck. He’s suing James and My Morning Jacket Tours, Inc. for an unspecified amount of money.
