
A man released from the Denver Jail after he allegedly killed someone in a hit-and-run crash, even though he was subject to a U.S. Immigration and Customs Enforcement civil detainer, is now in federal custody.
Ivan Gerardo Zamarripa-Castaneda, 26, from Mexico, reported at about 4:40 p.m. Friday to ICE offices on his own accord, according to a news release.
On March 5, ICE lodged an immigration detainer with the Denver Jail following Zamarripa-Castaneda’s arrest in a vehicular homicide investigation. The jail released Zamarripa-Castaneda on March 10 without notifying ICE beforehand as requested by the detainer.
Three Denver Sheriff’s deputies have been reassigned amid an investigation into the botched jail release.
According to the Friday ICE news release, Zamarripa-Castaneda on Jan. 2, 2015, legally entered the United States on a temporary visa that expired Feb. 13, 2015.
“He has overstayed his original temporary visa by more than three years,” the release said. “He remains in ICE custody pending disposition of his immigration case, or if he is transferred to local custody via a “writ of Habeas Corpus” to further his criminal prosecution.”
Zamarripa-Castaneda is accused of driving impaired and slamming into truck driver John Anderson, 57, of Lone Tree. Anderson died in the truck after it caught fire, and Zamarripa-Castaneda fled the scene and was arrested about 12 hours later.
