Two officers who shot and injured a woman in a medical center parking garage were justified in firing as the woman apparently tried to run them over, according to a letter from the 18th Judicial District detailing the decision.

The driver, Chayley Nicole Tolin, was charged in Arapahoe County Court in January with 12 felonies, including two counts of first-degree attempted murder.

On Jan. 16, an off-duty police officer called in a suspicious car in the Swedish Medical Center parking garage, which police found was stolen, prosecutors said.

As officers Ryan Kaspar and Sam Ayres approached the car, Tolin allegedly accelerated, locking eyes with Kaspar as she drove directly at him, police said. Ayres and Kaspar fired several rounds, police said, striking Tolin twice in the torso.

Police eventually caught Tolin and the other passenger, 35-year-old James Helms.

Helms told police that the two were heroin addicts and had been awake for two straight days. They had come to the parking garage to see the sunrise, he said, according to police.
