Suspect in fatal Brighton crash told police he was not in the car during crash /2025/12/30/brighton-fatal-hit-and-run-crash/ Tue, 30 Dec 2025 20:36:12 +0000 /?p=7380023&preview=true&preview_id=7380023 A man who was arrested for DUI vehicular homicide in a fatal crash along U.S. 85 in Brighton told police officers he was not in the vehicle at the time of the crash, but witnesses described him fleeing the scene.

Erik Diaz Olivas, 20, faces charges of vehicular homicide DUI driving, reckless endangerment, vehicular assault, possession/consumption of alcohol under the age of 21, failure to remain at the scene of the accident and a handful of other traffic offenses on Sunday, according to his arrest affidavit.

Brighton police officers who were responding early Sunday to a three-vehicle crash involving a Ford Escape and a GMC SUV near the intersection of U.S. 85 and Weld County Road 2 1/2 found Diaz Olivas lying on the ground between Weld County roads 2 1/2 and 2, according to his arrest affidavit. Diaz Olivas, described in the affidavit as heavily drunk, reportedly used a Weld County Sheriff’s patrol vehicle to support himself while hiccuping and saying that he was drunk.

Diaz Olivas, suspected of driving the Escape, told officers that he was riding in it and had asked to be let out before the crash and was running toward the area where police found him when the crash happened. He said he had been at a party drinking with his friends and wanted to be let out of the car because he is on probation and did not want to get in trouble.

Initial investigations found the Escape was traveling westbound on Weld County Road 2 ½ and failed to stop at the stop sign at the U.S. 85 intersection before crashing into a GMC SUV headed northbound on U.S. 85, according to a Brighton Police Department news release. Two of the people in the Ford were ejected from the car, and Diaz Olivas and another person fled the crash on foot. One of the people who was ejected was taken to a hospital and the other person was pronounced dead at the scene. The people in the GMC were also taken to a hospital.

In addition to denying being in the Escape at the time of the crash, Diaz Olivas said he couldn’t hear it but confirmed he could hear the sirens from responding emergency vehicles, according to the affidavit.

A witness told officers that Diaz Olivas fled from the driver’s seat of the Escape, walked to the passenger side and then ran south, according to the affidavit.

Police were later informed a woman from the GMC was extracted from her vehicle and told another officer “that car didn’t stop” multiple times. That woman also stated she saw the Ford Escape traveling at a high speed westbound while she was traveling on U.S. 85, and the affidavit states she said she did not have adequate time to slow down and avoid the crash.

Anyone with information about the crash can contact the Brighton police tip line at 303-655-8740. Diaz Olivas is currently in custody at the Weld County Jail. Police have until 3:30 p.m. Wednesday to officially file charges.
