A Cañon City woman arrested Tuesday evening after her three children were pulled from a back yard swimming pool faces charges of possession of a controlled substance and child abuse neglect, both felonies.

Appearing in Fremont County District Court in Cañon City this morning, Nina Davis, 25, was advised of the charges against her.

The 20-month-old and 2-year-old children rescued from the pool remained hospitalized at Memorial Hospital in Colorado Springs. Their conditions were not released, but their injuries are not believed to be life-threatening.

Cañon City police, who were called to a residence in south Cañon City at about 6:15 p.m. on a report that three children had fallen into a pool, gave the following account of the incident:

The father of one of the three children, Richard Valdez, 18, was working in the front yard of the residence when he heard a child screaming. He ran to the back yard, where he saw a 4-year-old child hanging on the side of a swimming pool. Valdez saw the two younger children in the pool and jumped in to retrieve them.

He told police that they were “unresponsive and blue in color.” Valdez began CPR, which he continued until relieved by emergency response personnel.

Davis, who had been taking a shower inside, called 911 when she heard Valdez screaming.

During the police investigation, Davis was asked to perform a voluntary drug test. She tested positive for methamphetamine, amphetamine, cocaine, and THC.

She is being held at the Fremont County Detention Center on $25,000 bond.
