LONGMONT, Colo.—A man entrusted by a neighbor to care for her 9-year-old boy is a registered sex offender who faces a new charge after the woman came home from work and allegedly found the man sexually assaulting her son.

Frank James Gutierrez, 62, faces at least one charge of sexual assault on a child by a person in a position of trust, police said.

Cmdr. Craig Earhart on Wednesday said Gutierrez was arrested Monday at about 10:30 p.m. He had been baby-sitting the boy for about two weeks while the boy’s mother went to work.

Gutierrez had been registered as a sexual offender with Longmont police since November 2005, police said. He had been convicted in San Diego in a case involving a 9-year-old girl.

Most law enforcement agencies have the sexual offender registry available online or on request.

“Trust your instincts and don’t be afraid to ask questions,” Earhart said. “Be very suspicious of odd behavior or if special attention is made toward your child that you don’t think is appropriate,” he said.
