GREELEY, Colo.—Two police officers who shot and killed a man identified as a gang member will not be criminally charged, District Attorney Ken Buck said.
Jimmy Joe Trevino, 22, who had a street name of “Psycho,” was killed early Aug. 15 after officers found him hiding inside a large trash bin, police said.
An investigation determined that before the shooting, Trevino cut off a court-imposed ankle monitor, threatened his wife with a gun, and told his wife he wasn’t going to let police take him back to prison, according to a report that Buck released Friday.
According to the report, Trevino’s wife told officers who were responding to a 911 call that Trevino assaulted her and told her he had shot his sister.
The officers later spotted Trevino, who fled and hid in a trash bin. Officers demanded to see his hands. The officers said they fired after Trevino reached into his pockets. No gun was found around Trevino.
An autopsy revealed he was shot eight times in the chest and abdomen. His blood-alcohol level was .187, more than twice the legal driving limit. His blood also tested positive for marijuana.
In the report released Friday, Buck said the officers were justified in their actions. The report said the officers “were presented with information that Jimmy Joe Trevino had threatened and assaulted his wife and that he assaulted and possibly murdered his sister with a handgun.”
Trevino’s wife and sister have denied to reporters that Trevino threatened or assaulted them, the Greeley Tribune reported.
