The University of Colorado filed a petition Tuesday asking for all the judges in the 10th Circuit Court of Appeals to review a September decision in a Title IX lawsuit brought by two former students.

Last month, a three-judge panel from the 10th Circuit reinstated the lawsuit by two women who say they were raped at a party for CU football recruits.

The judges pointed toward sufficient evidence that the school failed to supervise visiting high school football stars.

The university maintains that the court’s decision conflicts with earlier Supreme Court and 10th Circuit cases regarding responsibilities under Title IX.

CU lawyers say the decision “dramatically expands … the liability for all schools” for the conduct of their students.

The three-judge opinion has implications for “thousands of educational institutions receiving Title IX funds,” according to the brief.
