BOULDER, Colo.—A judge has ruled that a Louisville man accused in the death of his 10-week-old son will not have to go to trial in Boulder County.

Lawyers for Alex Midyette argued that their client could not get a fair trial in the county because media coverage of his case has tainted the jury pool.

Midyette is charged with fatal child abuse in his son’s death in 2006. He is accused of injuring his son. Midyette’s wife is serving 16 years in prison after being convicted of failing to get help for her son.

The trial may not be moving far. Prosecutors say the case should be held in the Denver area to prevent further delays. The new trial location has not yet been selected.

The trial is set to begin Oct. 6.
