Kachina McAlexander still faces three counts of aggravated assault for firing a handgun at South Dakota deputies, but the attempted murder charges against her were dropped on Tuesday.

Authorities say McAlexander, who had worked for the Denver Police Department for 10 years, shot at other officers who came to a motel in Custer, S.D., on March 24 responding to a report that McAlexander might be suicidal.

During a hearing Tuesday, a judge said the attempted murder case was the “thinnest” he had ever seen.

The judge ruled testimony from the deputies was not sufficient to sustain the attempted murder charges.

“I think the judge made the right decision, based on the law and the facts that were presented to him,” said Ellery Grey, McAlexander’s attorney, who said there wasn’t evidence that she tried to kill the deputies.
