DENVER—A Washington man accused of threatening the family of a Colorado doctor who performs late-term abortions says authorities violated his rights while questioning him, and he wants his statements kept out of court.

Donald Hertz of Spokane is accused of calling the Boulder Abortion Clinic in June and threatening to kill family members of Warren Hern. Hertz faces charges of making an interstate threat and of violating a 1994 law that protects access to reproductive health services.

A motion filed Tuesday in federal court in Denver claims FBI agents didn’t read Hertz his constitutional rights and held him against his will while questioning him at his home.

Attorneys for Hertz and the FBI didn’t immediately return calls for comment Tuesday.
