DENVER—A judge is sticking to her order for former Qwest CEO Joe Nacchio to appear in court in Denver to waive his right to attend re-sentencing hearings.

Nacchio’s attorney insisted in court filings that Nacchio wanted to skip the hearings and not delay a new sentence, but U.S. District Judge Marcia Krieger said Thursday she wouldn’t accept a written waiver.

She also rejected Nacchio’s request to come to Denver on his own, rather than wait for a federal escort. That means a re-sentencing hearing set next week will be pushed back.

Nacchio is in prison in Pennsylvania on insider trading convictions while Krieger recalculates a sentence of six years in prison and $71 million in fines and forfeitures, which an appeals court ruled was too harsh.
