Federal drug agents won a petition Friday seeking the prescription-writing records of three medical professionals who are under criminal investigation.
U.S. Magistrate Judge Michael Hegarty ruled the state Board of Pharmacy must honor subpoenas issued for the records of three prescribers from the state’s Prescription Drug Monitoring Database.
The Drug Enforcement Administration filed a suit in May against the Colorado Board of Pharmacy to obtain the records. The state’s contention was that the statute governing the database does not allow information about prescribers to be released to law enforcement, only patients.
The DEA’s lawsuit does not name the medical professionals.
