Two Denver police officers have appealed their termination by safety manager Charles Garcia, saying the firings were unsupported by the facts of the case.
Ricky Nixon and Kevin Devine filed the appeals to the Denver Civil Service Commission on Tuesday, said Brian Kellogg of the commission’s staff.
Garcia fired the two, who were accused of excessive force for an incident caught on camera outside the Denver Diner in 2009, on April 11.
The two were dismissed for “commission of a deceptive act.” Garcia found that the reports they filed after the arrests did not match other witness accounts.
In their appeal, both officers said the discipline is not supported by the preponderance of evidence.
