PUEBLO, Colo.—A Pueblo dad accused of shooting and killing his daughter in April will face first-degree murder charges in his upcoming trial.

The Pueblo Chieftain reports ( ) that a district judge rejected an argument by the lawyer for 33-year-old John French Jr. that he should face a second-degree murder charge instead.

Authorities say French shot his 8-year-old daughter Desirea French in their home.

Pueblo Detective JC Williams confirmed that French said he was diagnosed with depression and bipolar disorder, but wasn’t on any medication for the illnesses.

French will be back in court in November.
