GRAND JUNCTION, Colo. (AP) — Attorneys for a 17-year-old charged with killing a western Colorado sheriff’s deputy are seeking to have their client’s case moved back to juvenile court.
The Daily Sentinel reports (http://bit.ly/1Rh5nSB ) that Austin Patrick Holzer’s attorneys have filed a motion reserving their right to ask that the case be returned to juvenile court.
Holzer is facing a first-degree murder charge in the Feb. 8 shooting that killed Mesa County Deputy Derek Geer.
Holzer was initially charged as a juvenile, but prosecutors refiled the charges to have him tried as an adult.
Geer had been trying to arrest Holzer on charges of violating probation in a sex-assault case.
According to an arrest warrant affidavit, Holzer told police he tried but failed to shoot himself before turning the gun on Geer.
