Noah Feldman wrote that it’s fine for Supreme Court justices to speak their mind. Not so under the Code of Judicial Conduct, which in Canon 1 says, “A judge shall uphold and promote the independence, integrity and impartiality of the judiciary, and shall avoid impropriety and the appearance of impropriety.”
Can anyone doubt that Justice Ruth Bader Ginsburg violated the appearance of impropriety and stepped right into actual impropriety by failing to promote the independence, integrity and impartiality of the judiciary?
If Donald Trump wins the presidency, Ginsburg will have to resign or recuse herself from every case involving the United States of America as a party. She should resign now. Judges work as unelected political appointees, but that does not eliminate their duty of impartiality.

Someone needs to let Donald Trump know, regarding his call for Justice Ruth Bader Ginsburg to resign from the Supreme Court, that having his feelings hurt is not an impeachable offense.
