El Paso County settles lawsuit over jail injuries

Woman’s five-day stay in jail left her with bruises, other injuries

COLORADO SPRINGS, Colo. — El Paso County has agreed to a $675,000 payout to a woman who claimed that deputies had pulled her legs out from under her and shoved her to the floor.

The Gazette reports county commissioners have agreed to settle the lawsuit filed in April 2016 by Philippa McCully, who claimed her five-day jail stay in April 2014 had left her covered in bruises, her ACL torn, knee fractured and with other injuries.

Senior Assistant County Attorney Lisa Kirkman says the settlement is not an admission of fault or liability but it was to avoid additional litigation costs.

Undersheriff Joe Breister told commissioners Tuesday that the sheriff’s office has reviewed and revised policies on use-of-force practices and bolstered training efforts.
