Daniel Peña, who was eligible for parole, was beaten on Nov. 20 and was pronounced dead Sunday, said Mark Fairbairn, spokesman for the Colorado Department of Corrections.

“We’re treating this assault as a homicide,” Fairbairn said.

He declined to name the suspect in the beating.

Fairbairn said the assault was an isolated incident.

Peña, who had been sentenced in 2014 for drugging a victim, was scheduled for release on March 21, 2019, Fairbairn said.
